The Registrar of Companies in Hyderabad has issued an order concerning the violation committed by M/S. Oscar FX Private Limited. The company appointed Ms. Vijaya Bharathi Pendyala as an additional director without a valid Director Identification Number (DIN), which is in breach of Section 152(3) of the Companies Act, 2013. Consequently, both the company and its officers are considered to be in default and are subject to penalties outlined in Section 159 of the same Act.

Section 159 of the Companies Act, 2013 states that individuals or directors who fail to comply with provisions mentioned in sections 152, 155, or 156 may face penalties. These penalties can range up to fifty thousand rupees, and in cases of ongoing defaults, an additional penalty of up to five hundred rupees per day may be imposed.
According to the order, the company and its officers have been directed to pay a penalty of Rs. 41,900/- within a 30-day timeframe. The penalty for the company is governed by Section 159 in conjunction with Section 446B of the Act, while the penalty for Mr. Kamal Pasupulati (Managing Director) is determined as per the Act. The penalties are calculated based on the number of days of default, which in this instance amounts to 169 days from the date of DIN allotment.
The order also specifies that the defaulters must submit e-Form INC-28 along with proof of payment to the Registrar of Companies in Hyderabad within the specified timeframe.
