This requirement applies specifically to those filing ITR-3 and ITR-4, while individuals using other ITR forms such as ITR-1, ITR-2, and others are not obligated to submit Form 10IE.
What is the new tax regime?
The new tax regime refers to an alternative tax structure introduced by the government that offers lower tax rates compared to the traditional or old tax regime. Under the new tax regime, many deductions and tax benefits that were available in the old regime are not allowed.
Taxpayers have the option to choose between the old and new tax regimes based on their preference and financial circumstances. It's important to note that this choice must be made and submitted using Form 10IE before filing the income tax return.

When to submit Form 10IE?
Form 10IE needs to be submitted prior to filing your income tax return (ITR). It is important to complete the submission of Form 10IE before initiating the process of filing your ITR under the new tax regime.
Once you have successfully submitted Form 10IE, you will receive a 15-digit acknowledgment number. This acknowledgment number is crucial and must be mentioned when filing your ITR under the new tax regime. It serves as proof that you have opted for the new tax regime and allows you to proceed with the ITR filing process accordingly.
Time limit for filing Form 10IE
Individuals with business income who wish to file Form 10IE should do so before the due date of filing their income tax return (ITR). The regular due date for filing ITR is typically July 31st of the assessment year. However, it's important to note that the government may extend the due date in certain cases.
Therefore, taxpayers should ensure that they file Form 10IE before the applicable due date of filing their ITR. This allows them to meet the requirement of submitting Form 10IE within the specified timeframe and proceed with filing their ITR under the new tax regime. It's advisable to stay updated on any official announcements or notifications regarding the due date to ensure compliance.
How to File?
To file Form 10IE online, you can follow these steps:
STEP 1 - Access the e-filing portal: Visit the official e-filing portal of the income tax department.
STEP 2: On the dashboard, click ‘e-File’ > ‘Income tax forms’ > ‘File Income Tax Forms’
STEP 3: Scroll down to select Form 10-IE. Alternatively, enter Form 10-IE in the search box. Click on ‘File now’ button to proceed.
STEP 4: Select the Assessment Year for which you are filing the return. For eg: If you are filing taxes for the income earned in FY 2022-23, then select AY 2023-24.
STEP 5: After clicking on 'Let's Get Started', you will be directed to Form 10-IE, which consists of four sections:
(a) Assessing Officer: In this section, the details of the Assessing Officer will already be filled in for you. You simply need to review these details and confirm their accuracy.
(b) Basic Information: This section pertains to providing essential personal and contact information. You will need to enter details such as your name, address, PAN (Permanent Account Number), and other relevant information as required by the form.
(c) Additional Information: The third section of Form 10-IE is for providing any additional information that may be necessary. This may include details specific to your business or profession income, if applicable. Enter the required information accurately in the provided fields.
(d) Verification: The final section of the form is the verification section. Here, you will need to sign and declare the information provided in the form as true and correct to the best of your knowledge. The verification section may also require you to enter the date and place of verification.
STEP 6: Basic Information
Under Basic Information section, all your basic information like Name, PAN, Address are auto-filled. You will be required to provide the following information:
Whether you have any income from business or profession? (Select ‘Yes’)
Now select the ‘Nature of Business’. You may choose multiple business codes, if applicable.
STEP 7: In the Assessing Officer section, you need to provide information about any IFSC units you have, if applicable. Additionally, you must indicate whether you had chosen to pay tax according to the new tax regime in any previous years and if you now want to withdraw that choice. After entering this information, make sure to save it before moving on to the next section.
Step 8: Verification
Verification section contains self-declaration where you will be required to check the boxes and agree to the terms and conditions. Verify whether all the details are correct and save the information. Once done, click on ‘Preview’ to review Form 10IE.
Step 9: After reviewing all the information, ‘Proceed’ to e-verify'. You can e-verify either through:
Aadhaar OTP
Digital Signature Certificate (DSC)
Electronic Verification Code (EVC)
STEP 10: After successfully e-verifying your filed form, a message confirming the success will be shown. This message will include a Transaction ID and an Acknowledgement Receipt Number. It is important to make a note of these numbers for future reference. Additionally, you will receive a confirmation message on the email ID registered with the e-Filing portal.
To download the filed form and locate the acknowledgment number, follow these steps: Go to the 'e-File' section on the portal and navigate to 'Income Tax Forms'. From there, select 'View Filed Forms'. You will be able to download the form and find the acknowledgment number within the downloaded document.
Remember to keep a record of the Transaction ID, Acknowledgement Receipt Number, and any confirmation emails for your records and reference.
How to switch between the old and new tax regimes?

Individuals with business income have a limited opportunity to switch between the old and new tax regimes. They can choose the new tax regime once, but only once in their lifetime. After selecting the new tax regime, they have the option to switch back to the old regime if they desire. In essence, individuals with business income have a one-time chance to switch between the tax regimes, after which they will be bound by their final choice. | An individual who earns salaried income and does not have business income has the flexibility to switch between the new and old tax regimes on an annual basis. They can choose either the new or old tax regime each year based on their preference and financial circumstances. Unlike individuals with business income, there are no limitations on the number of times they can switch between the tax regimes. This allows them the freedom to evaluate the benefits and drawbacks of both regimes each year and make an informed decision accordingly. |
